You agree and understand that the content of any exam, test, information, document, or material provided to you through your account, will be kept strictly confidential, and will not be used, by you for any purpose other than consideration of the transactions described therein, except to the extent such information (i) was already known to the recipient or its representatives, otherwise than as a result of the improper disclosure by any person, (ii) hereafter becomes available to the recipient otherwise than as a result of the improper disclosure to it or them by any person, or (iii) must be disclosed to, or filed with, any governmental agency or authority pursuant to applicable law or legal process. Notwithstanding the foregoing, the contents and existence of any exam, test, material, information, or document can be used in connection with bona fide litigation proceedings involving the parties hereto.
